Property and Sovereignty in America: A History of Title Registries & Jurisdictional Power.

This Article tells an untold history of the American title registry, a colonial bureaucratic innovation that, though overlooked and understudied, constitutes one of the most fundamental elements of the U.S. property system today. Prior scholars have focused exclusively on the registry's role in catalyzing property markets, while mostly overlooking the main sources of this property in the American colonies: expropriated lands and enslaved people. This analysis centers the registry's work of organizing and "proving" land claims that were not only individual but collective, to affirm encroachments on tribal nations' lands. In this way, registries helped scaffold the colonies' tenuous but growing political and jurisdictional power. The specific history of the U.S. title registry illustrates a crucial dynamic between property and sovereignty. In America, property and property institutions did not issue from sovereigns with established authority to govern a territory, as in the understanding drawn from European legal traditions. Rather, property institutions, exemplified by the title registry, preceded and ushered in colonial and U.S. sovereign title to Native homelands. This Article presents new questions about how the legal infrastructure of property furthered European colonists' conquest and how this progression of conquest on the ground produced the national jurisdiction and real-estate market of today. Leveraging established scholarship on the colonies and deploying original research on county creation, it shows that in the haphazard history culminating in the American title registry, colonists borrowed the English legal forms of the registry and county and remade them into local tools of colonial territorial expansion. The registry and county became key local governmental forms that drew settlers into Native nations' territories and encouraged them to claim lands by reassuring those settlers that their claims would become real property. The time map of county creation--not of the formation of territories, nor the admission of states, nor the conclusion of treaties--most accurately tracks where the United States grew its jurisdictional power, and when. The United States created counties and registries between its plans to invade and its actual ability to govern lands, before the naming of transitional territories, and often even before obtaining Native cessions to the lands by treaty. In the history of conquest, county creation thus lies in the transition between mere white entitlement and actual title. And as a consequence of this history, counties came to underpin the national jurisdiction, and the local institution of the registry became the common and continuous infrastructure for the entire national real-estate market. This Article's history of the title registry underscores the conceptual and practical stakes of redressing the erasure of race from our understanding of legal institutions and development. In particular, this history challenges us to recognize less obvious ways that the legacies of conquest and enslavement survive to structure our landscape and lives. Race works to shape law and legal outcomes in ways that many now recognize, such as by excluding people from institutional protections and benefits and through the predatory risks of formal inclusion. But the registry's history also illustrates a third phenomenon: the phenomenon of legal innovation spurred by white settlers' willingness to view racial violence as an economic resource, which introduced new institutions and practices that may appear to be facially "race-neutral" but promote the production of property value through the dehumanizing logic of race. Colonists constructed minimalist registries, which did not authenticate title claims and encouraged their proliferation. In this way, they prioritized the collective goal of building jurisdictional power at the direct expense of Native and Black communities whose lands and people colonists rapaciously claimed as property for that ever-growing market. The result was an institution that continues to privilege the production of property value above all--above protecting individual property interests, and above sustaining homes, communities, and life, in ways that now affect us all. The Fish Lands : German Trade with Iceland, Shetland and the Faroe Islands in the Late 15th and 16th Century

The late medieval German trade with the North Atlantic islands, in the margins of the Hanseatic trade network, has received only limited scholarly attention. Merchants from predominantly Hamburg and Bremen established direct trade relations with these islands in the late 15th century, and managed to control the international trade with Iceland, the Faroes and Shetland for much of the 16th century. However, the Hanseatic commercial infrastructure was absent in the North Atlantic, which forced these merchants to develop new trade strategies. Besides a critical re-evaluation of the economic and political conditions, this volume offers a comprehensive study of the organisation of the trade and the methods used to establish and maintain networks between islanders and German merchants. Moreover, it analyses the role and socio-economic position of the communities of merchants with the North Atlantic in their home towns. The book shows that the North Atlantic trade was anything but insignificant. It was a dynamic and integral part of the trade network of the northern German cities, and its study is highly relevant for the economic history of Northern Europe.

In 1923, a young woman named Bella Tarakhovskaia arrived in Seattle aboard the SS President Jackson. She had sailed from Yokohama, Japan but her voyage to America had begun much further away. Born in Melitópol' Ukraine, she had lived in East Asia, and was now on her way to join her older brothers in Detroit, Michigan. Tarakhovskaia (1903-1983) was not only well-traveled but also deeply musical: she carried with her two bound volumes of print and manuscript scores that she had collected for her personal use. These albums documented her own development as a musician and her awareness of artistic tastes within the Ukrainian diaspora. They also capture her experience of musical life in Harbin, China, a place that attracted numerous émigrés and refugees in the early twentieth century. The kharbintsy, as these residents became known, were a highly diverse group. In the early 1920s, Harbin transitioned from Russian rule to local control. Tarakhovskaia's collection offers a rare surviving example of amateur musical interests during an important period of change. Her music represents an expansive network of international music printers, publishers, and sellers, suggesting the remarkable paths of transmission through which Western repertoire was disseminated among émigrés in East Asia. It reveals the continuing influence of Imperial Russia and features some of the Jewish (and non-Jewish) artists who sought to establish their careers amidst a new, tumultuous context. Perhaps most importantly, the music reflects the complicated political and social relationships that shaped Harbin's artistic landscape. Like the city itself, Tarakhovskaia's collection shows that it was possible for musical life to flourish among the kharbintsy even in the midst of upheaval and uncertainty. [ABSTRACT FROM AUTHOR]

This essay develops a constructive account of the ways Anglicans have addressed political questions. The first section outlines the characteristic political rationality of Anglican political theology (APT). This provides a backdrop to a consideration of the relationship between three distinct yet interrelated phenomena—church, nation, and state—and how they were understood as together constituting a polity. The second half situates APT in the context of how Anglicanism, from its origins, is in part a response to processes of modernization, particularly as these emerged in the Atlantic world from the fifteenth century onwards. It then outlines how key concerns of APT emphasize a way of imagining the role of church and nation within history, with providence as an important doctrinal point of reference. That Loch Ness Monsters, "Nessies", might exist has been argued by many people on the basis of films, sonar contacts, photos, and eyewitness accounts. At the same time, some observers have insisted that these are not real creatures, nothing but misperceptions of natural phenomena or known animals. Their arguments typically address the weakest evidence (eyewitness accounts) rather than the strongest objective evidence of sonar and film. Such evasion or avoidance constitutes a strategy of misdirection, as does the insistence that, since Nessies are not recognized by "science," therefore taking their possible existence seriously amounts to doing pseudo-science. Debunkers are arguably irrational and go beyond the evidence in declaring that Nessies are definitely non-existent. Although Nessie fans do believe that they exist, most will admit that final proof requires a specimen or detailed close-up of unequivocally valid photography and insist only that enough evidence exists to warrant further searches: that is not pseudo-science. The Lives of Stories traces three stories of Aboriginal–settler friendships that intersect with the ways in which Australians remember founding national stories, build narratives for cultural revival, and work on reconciliation and self-determination. These three stories, which are still being told with creativity and commitment by storytellers today, are the story of James Morrill's adoption by Birri-Gubba people and re-adoption 17 years later into the new colony of Queensland, the story of Bennelong and his relationship with Governor Phillip and the Sydney colonists, and the story of friendship between Wiradjuri leader Windradyne and the Suttor family. Each is an intimate story about people involved in relationships of goodwill, care, adoptive kinship and mutual learning across cultures, and the strains of maintaining or relinquishing these bonds as they took part in the larger events that signified the colonisation of Aboriginal lands by the British. 'I know no place where firm and paternal government would sooner produce beneficial results then in the Solomons … Here is an object worthy indeed the devotion of one's life'.Charles Morris Woodford devoted his working life to pursuing this dream, becoming the first British Resident Commissioner in 1897 and remaining in office until 1915, establishing the colonial state almost singlehandedly. His career in the Pacific extended beyond the Solomon Islands. He worked briefly for the Western Pacific High Commission in Fiji, was a temporary consul in Samoa, and travelled as a Government Agent on a small labour vessel returning indentured workers to the Gilbert Islands.As an independent naturalist he made three successful expeditions to the islands, and even climbed Mt Popomanaseu, the highest mountain in Guadalcanal. However, his natural history collection of over 20,000 specimens, held by the British Museum of Natural History, has not been comprehensively examined. The British Solomon Islands Protectorate was established in order to control the Pacific Labour Trade and to counter possible expansion by French and German colonialists. It remaining an impoverished, largely neglected protectorate in the Western Pacific whose economic importance was large-scale copra production, with its copra considered the second-worst in the world.This book is a study of Woodford, the man, and what drove his desire to establish a colonial protectorate in the Solomon Islands. In doing so, it also addresses ongoing issues: not so much why the independent state broke down, but how imperfectly it was put together in the first place.David Russell Lawrence is an anthropologist who has managed environmental programs in Melanesia and Southeast Asia for the Great Barrier Reef Marine Park Authority. His most recent book was a re-examination of the place in Melanesian anthropology of the Finnish sociologist Gunnar Landtman who spent two years working with the Kiwai people of the lower Fly estuary. He recently managed a large-scale survey of 300 communities in the Solomon Islands for the Community Sector Program and has assisted with a number of the annual RAMSI People's Surveys in the islands. This work has given him insight into the colonial heritage of the Solomon Islands and a desire to tell the story of the establishment of the British Solomon Islands Protectorate through the eyes of the first Resident Commissioner, Charles Morris Woodford.

William Sharp (1855-1905) conducted one of the most audacious literary deceptions of his or any time. Sharp was a Scottish poet, novelist, biographer and editor who in 1893 began to write critically and commercially successful books under the name Fiona Macleod. This was far more than just a pseudonym: he corresponded as Macleod, enlisting his sister to provide the handwriting and address, and for more than a decade'Fiona Macleod'duped not only the general public but such literary luminaries as William Butler Yeats and, in America, E. C. Stedman. Sharp wrote'I feel another self within me now more than ever; it is as if I were possessed by a spirit who must speak out'. This three-volume collection brings together Sharp's own correspondence – a fascinating trove in its own right, by a Victorian man of letters who was on intimate terms with writers including Dante Gabriel Rossetti, Walter Pater, and George Meredith – and the Fiona Macleod letters, which bring to life Sharp's intriguing'second self'. With an introduction and detailed notes by William F. Halloran, this richly rewarding collection offers a wonderful insight into the literary landscape of the time, while also investigating a strange and underappreciated phenomenon of late-nineteenth-century English literature. Winner of the Juanita Brooks Prize in Mormon Studies Frontiersman, colonizer, missionary to the Indians, and explorer of the American West, Jacob Hamblin has long been one of the most enigmatic figures in Mormon history. In this defining biography, Todd Compton examines and disentangles many of the myths and controversies surrounding Hamblin. His Grand Canyon adventures and explorations as a guide alongside John Wesley Powell are well documented, as are his roles as a missionary, cultural liaison, and negotiator to the Indian tribes of southern Utah and Arizona. Hamblin struggled in this latter role, sometimes unable to bridge the gulf between Mormonism and Indian culture. He disavowed violent conflict and ceaselessly sought peaceful resolutions where others resorted to punitive action. He strove above all for mutual understanding in the absence of conversion. A Frontier Life provides a rich narrative that fleshes out a picture of a sometimes vilified figure, particularly in regard to his connection to the infamous Mountain Meadows Massacre, where Compton provides nuanced discussion clarifying Hamblin's post-massacre role—he was not present at the massacre, but reported on it to both Brigham Young and military investigators. Compton's engagement with Mormon historiography and previous Hamblin portrayals will make this work of particular interest to both scholars and students. SOVEREIGNTY AND DEPENDENCE IN THE AMERICAN EMPIRE: NATIVE NATIONS, TERRITORIES, AND OVERSEAS COLONIES.

What justifies plenary powers over Native nations, U.S. territories, and overseas colonies? One answer is the text of the Constitution: the Indian Commerce Clause or the Territorial Clause. Another answer is sovereignty under international law. In this Article, I argue that these legalistic explanations overlook a third answer: that political and judicial actors justified plenary powers based on the colonial notion that these so-called dependent peoples were incapable of selfgovernment. Members of Congress, presidents, federal judges, and territorial governors reconciled republicanism and colonialism in the American empire by constituting Native nations, the territories, and the overseas colonies as dependent peoples. This Article unmasks how the legal framework of colonialism rested on their infantilization, the temporal character of colonial rule, and the pretense that it was for their benefit. Federal rule was justified because they were "wards of the nation," "in a state of infancy," or in "political childhood," waiting to learn how to govern themselves. The Article examines the judicial decisions, political speeches, and academic publications that infantilized these dependent peoples and how tribal and territorial sovereignty was contingent upon an expansive concept of dependency. The Article is a cautionary tale about redemption through constitutionalism, either judicial constitutionalism (ending plenary powers) or legislative constitutionalism (repurposing plenary powers). Overruling any of the individual cases that legitimized these plenary powers-including United States v. Kagama or the Insular Cases-will not undo colonial dependence or American imperialism. Instead, it will only conceal how the Constitution and the Supreme Court have long been complicit in empire. Constitutional redemption for the benefit of Indigenous peoples and colonized peoples ignores how central dependence and colonialism are to U.S. constitutionalism. Rather than ending or repurposing plenary powers, this Article concludes that only through democratic politics, social movements, and anticolonial solidarities can we undo the dependencies left by colonial rule. The emancipation of dependent peoples will only be possible if democratic decolonization takes precedence over constitutional interpretation. [ABSTRACT FROM AUTHOR]
