Recent research conducted in Sri Lanka has revealed that victim survivors of conflict-related sexual violence (CRSV) and their notions of justice and accountability are influenced by their lack of trust in an ineffective criminal justice process. Moreover, the fear of reprisal by State allied perpetrators deters them from accessing formal justice. The failure of a criminal justice system steeped in patriarchal, discriminatory gender insensitive procedures in which CRSV victim survivors search for justice is analyzed through a recent judgment. The case highlights that searching for accountability in the current political context is not feasible and that CRSV victim survivors must be provided with support systems and forms of relief to move on with their lives until justice and accountability can be achieved. The article argues that although criminal accountability is the ideal, alternative possibilities for justice for CRSV victim survivors in Sri Lanka need to be explored, given the Sri Lankan political context and a criminal justice process fraught with many challenges. The role of the Office for Reparations in providing reparations to CRSV victim survivors and the options of a "partial" justice are discussed.

A UNHRC Resolution of Questionable Legality on Sri Lanka and its Importance as a Catalyst for Future UN Reform

From 2012-2019, the United Nations Human Rights Council (UNHRC) adopted a series of resolutions on Sri Lanka calling for accountability for war crimes and other crimes purportedly committed during the war against the Liberation Tigers of Tamil Eelam (LTTE). This paper challenges the traditional narrative regarding the resolutions – ie that it was a well-intentioned effort by the sponsoring nations, the United States (US) and its allies, to foster peace and reconciliation in Sri Lanka. Instead, this paper argues that in pursuing the resolutions, the UNHRC has violated the fundamental principles of the Charter of the United Nations (UN Charter) as well as the UNHRC’s founding documents. The author contends that, through these resolutions, the US and its allies have developed a series of innovative tactics to enable them to intervene in the internal affairs of weak nations by using the UNHRC as a conduit. It is in the interest of the friends of the United Nations (UN) and, in general, all persons who value the rule of law in international affairs to know about what has happened so that they can advocate for the relevant reforms in order to prevent the UN from losing its credibility any further.

PORTUGUESE IMPERIAL BUILDING IN THE KOTTE KINGDOM OF SRI LANKA AS A REFLECTION OF 16TH CENTURY INTERNATIONAL LAW

The colonial nature of international law has been a moot point in legal academia, which univocally suggests international law as an imperial instrument. Given these exergies, the question that this paper seeks to examine is how Portuguese encounters in the 16th century Sri Lanka reflects the seeds of international legal system dominated by European interests. The policy espoused by the Portuguese in Sri Lanka during their encounters with the Kotte kingdom raise the initial examples of unequal treaties, exclusion of sovereignty and the adoption of “puppet rulers”. This paper makes a critical inquiry in examining these elements parallel to the development of 16th century international law.

Awareness of the Differences Between Islamic Insurance and Conventional Insurance amongst Students of Islamic Studies in Sri Lanka

The purpose of this study is to assess the level of awareness and understanding of Takaful, an Islamic insurance scheme, as compared to traditional insurance among students of Islamic Studies in Sri Lanka. Despite the growing popularity of Takaful in the country, there is a notable lack of awareness and understanding of this concept among Sri Lankans. By conducting a survey among Sri Lankan students, this research seeks to determine the level of awareness and acceptance of Takaful, while identifying the factors that influence this perception. The research methodology employed was to collect data through questionnaires distributed to customers in Sri Lanka. The findings indicate that although there is a growing demand for Takaful in the country, a significant portion of the population is either unaware of its existence or hesitant to adopt it due to prevailing misconceptions. The study highlights the importance of increasing awareness and understanding of Takaful to encourage greater participation in this form of insurance. In addition, future research could examine the reasons for limited engagement with Takaful and explore strategies to promote insurance literacy and active participation in the industry.

Awareness of Copyright Infringement Among Undergraduates of The State Universities in Sri Lanka

Copyright infringement is known as the use of copyrighted works without the permission of the creators, copyright holders or authors. It is a form of dishonesty and a violation of the authors' economic and exclusive rights. In general, copyright infringement activities have taken place in various ways such as theft, piracy, reuse and plagiarism among students pursuing degree programmes in higher education institutions in Sri Lanka. In this backdrop, this study aims to examine awareness of copyright infringement among students pursuing undergraduate degree programmes at state universities in Sri Lanka. The primary and secondary data have been used in the study. The primary data were collected by Self-Administered Questionnaires (SAQ) distributed to 356 of the selected participants. Selected students are continuing their education in 2016/2017, 2017/2018, 2018/2019 and 2019/2020, including general and honours degree programmes. The samples were selected based on Random Sampling Method (RSM). All received questionnaires were analysed in a descriptive way with the help of SPSS (Version-26) and the results were presented by illustrating in the form of tables. According to the results, it was found that 58.1% of participants were not aware that copyright infringement as an academic dishonesty, as well as copyright law (Intellectual Property Act No.36 of 2003) which is enforced by Sri Lankan government in order to protect intellectual properties. 77.4% of the participants proved that copyright infringement is a kind of prohibited act in their own religion (Islam, Buddhism, Christianity and Hinduism). Moreover, the main factors that lead to copyright infringement of study samples were a lack of awareness of copyright law (38%), the high cost of textbooks (64.6%), and the fear of having low greats in semester examinations (77.4%). The findings of present study would be important to stimulate academics, library personnel, university officials, and policymakers to think of ways to prevent the students from engaging in copyright infringements in future. Moreover, it is a firm belief of the researchers that findings of this study could be a remarkable starting point for future researchers.

Islamic Financing refers to the financing activity that complies with Islamic law and its practical application through the development of Islamic economics. It is one of the fastest-growing sectors in the world. The activities of Islamic Financial Institutions are found in all over the globe. In Sri Lanka, Islamic banking was introduced by Amana investment in 1997. Started primarily to cater for the Muslim community as a private operation, it had become to be one of the growing financial sectors in Sri Lanka. More than 19 financial institutions offer Islamic finance services in Sri Lanka, including one fully-fledged Islamic bank and seven Islamic banking window operations. Overall, the performance of Islamic banking services has been identified by researchers as steady but slow compared to the growth of conventional finance. There is a huge potential for the Islamic banking and finance industry to grow and reap its full potential with proper regulatory and institutional support. Islamic finance had been used by Muslims and non-Muslim customers in the country irrespective of religious influence. There had been valid concerns over this burgeoning industry in Sri Lanka that need to analyze in detail. Therefore, this research aims to determine the awareness level of non-Muslims of Ampara district in Sri Lanka about Islamic financial institutions and identify whether they realize the existing difference between Islamic financial institutions and conventional financial institutions in Sri Lanka. This study had been carried out using quantitative methods. For this study, primary data were collected through the questionnaire. Questions were distributed to all the respondents through Google Forms, and data was obtained. Among the selected sample size of 200 respondents, only 165 questionnaires were valid and used for the data analysis. The questionnaire consists of two parts: the first part requires the details of the respondents, and the second part deals with the awareness level regarding financial institutions. Collected primary data was analyzed through Microsoft Excel and presented through the tables and figures. Secondary sources were collected through academic journals, books, research articles, and thesis and website articles. According to the findings, even if non-Muslims are as aware of Islamic financial institutions as conventional financial institutions, their engagement level in them could be much higher.
