TESTING THE LIMITS OF VIRTUAL COMPLIANCE: WEBSITE ACCESSIBILITY, "TESTER" PLAINTIFFS, AND ARTICLE III STANDING UNDER THE ADA.

Federal courts have split in determining whether "tester" plaintiffs bringing suit under the ADA assert the requisite injury in fact necessary for Article III standing. These "website accessibility testers" allege that defendants' websites do not make certain information available to disabled persons in violation of Title III of the ADA and one of its implementing regulations. This split presents an excellent opportunity to clarify which informational and stigmatic harms qualify as injuries in fact for Article III standing purposes. This Note argues that ADA website accessibility testers cannot obtain standing under current law. Neither the text of the ADA nor the Supreme Court's recent standing decisions support standing for website accessibility testers. However, this Note also suggests that a statutory addition to the ADA in the form of a qui tam provision may provide a legislative workaround that would enable testers to proactively enforce Title III. This book examines the implications of Article 12 of the UN Convention on the Rights of Persons with Disabilities (CRPD), its resulting standard of protection for persons with disabilities and the way it is understood and implemented in its diverse signatory states. Its overarching theme is to assess the impact of CRPD Article 12 on the private law concept of legal capacity and its limitations, the significance of which carries over into the realm of penal law regulations. Its impact is analysed primarily from the legal point of view, but with due regard for its psychological and psychiatric ramifications. Recognising the importance of these disciplines is important when implementing CRPD Article 12 into domestic law, as they contribute to the determinants in creating a qualificatory legal framework for all, persons with disabilities in particular, to exercise their rights to legal capacity without let or hindrance. As active legal capacity is a notion rooted in and coming from private law, this forms the main research perspective. The first section discusses the foundational concepts constituting the CRPD Article 12 standard from domestic private law and international law perspectives. The work shows that the concepts adopted in private law interact with the protection of persons with disabilities as victims provided for in criminal law. In addition, where relevant, authors also look at public law institutions that are connected with the private law solutions. The volume will be an essential reference for academics, researchers and policy-makers working in the areas of private law, criminal law, mental health law, human rights, discrimination law as well as psychology and psychiatry.

Noncommunicable Diseases: A Compendium introduces readers to noncommunicable diseases (NCDs) – what they are, their burden, their determinants and how they can be prevented and controlled. Focusing on cardiovascular disease, diabetes, cancer and chronic respiratory disease and their five shared main risk factors (tobacco use, harmful use of alcohol, unhealthy diet, physical inactivity and air pollution) as defined by the United Nations, this book provides a synopsis of one of the world's biggest challenges of the 21st century. NCDs prematurely claim the lives of millions of people across the world every year, with untold suffering to hundreds of millions more, trapping many people in poverty and curtailing economic growth and sustainable development. While resources between and within countries largely differ, the key principles of surveillance, prevention and management apply to all countries, as does the need to focus resources on the most cost-effective and affordable interventions and the need for strong political will, sufficient resources, and sustained and broad partnerships. This compendium consists of 59 short and accessible chapters in six sections: (i) describing and measuring the burden and impact of NCDs; (ii) the burden, epidemiology and priority interventions for individual NCDs; (iii) social determinants and risk factors for NCDs and priority interventions; (iv) global policy; (v) cross-cutting issues; and (vi) stakeholder action. Drawing on the expertise of a large and diverse team of internationally renowned policy and academic experts, the book describes the key epidemiologic features of NCDs and evidence-based interventions in a concise manner that will be useful for policymakers across all parts of society, as well as for public health and clinical practitioners. Do the United States and France, both post-industrial democracies, differ in their views and laws concerning discrimination? Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars—including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others—Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at “colorblind” policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Overview The aim of the International Conferences'Economic Scientific Research-Theoretical, Empirical and Practical Approaches'- (ESPERA), initiated in 2013 by the'Costin C. Kirițescu'National Institute for Economic Research (NIER) within the Romanian Academy is to present and evaluate the economic scientific research portfolio, to argue and substantiate the Romanian development strategies - including European and global best practices, to provide an opportunity for researches, practitioners, and academics interested in economic scientific research, both theoretical, practical and empirical discuss and exchange insightful research ideas. The 7th edition of the International Conferences “Economic Scientific Research-Theoretical, Empirical and Practical Approaches”- (ESPERA), under the title ”30 Years of Inspiring Academic Economic Research – From the Transition to a Market Economy to the Interlinked Crises of 21st Century” was organized virtually during 26th -27th November 2020, In Bucharest, Romania. The event, dedicated to the 30th anniversary of NIER and its economic research network of its return under the auspices of the Romanian Academy, will include a scientific program of wide diversity initiatives, bringing together researchers from all NIER institutes and centers, members of the Romanian Academy, Romanian academic researchers and also guests from other countries. This book draws on more than a decade of workshops organised by the Greater China Australia Dialogue on Public Administration, involving scholars and practitioners from Mainland China, Hong Kong, Taiwan and Australia. Although these workshops recognised the major differences in the institutional frameworks of these jurisdictions, until recently they focused largely on the shared challenges and the diffusion of ideas and approaches.As rising international tensions inevitably draw attention to areas where interests and philosophies diverge, it is the differences that must now be highlighted. Yet, despite the tensions, this book reveals that these jurisdictions continue to address shared challenges in public administration.The book's contributors focus in detail on these four areas:intergovernmental relations, including the shifting balance between centralisation and decentralisationbudgeting and financial management, including during and after the COVID-19 pandemicthe civil service, its capability, and its relationship with government and the publicservice delivery, particularly in health and aged care.This book is aimed at a wide readership, not only at those within the jurisdictions it explores. It emphasises the importance of continued engagement in understanding different approaches to public administration—confirming fundamental philosophical differences where necessary but also looking for common ground and opportunities for shared learning.

In response, federal, state, and local governments have undertaken containment and mitigation efforts to “flatten the curve”—that is, to slow widespread transmission that could overwhelm the nation's health care system and to reduce spread of the disease while treatments and vaccines are being developed that will lessen the health impact of the virus. This book provides answers to numerous questions related to COVID-19 testing, including types of testing available and their reliability. It also discusses basic principles of contact tracing to stop COVID-19 transmission.

It considers how the coronavirus pandemic has been negotiated in different cultures and countries, with the final part of the volume focusing on South Asia and Pakistan in particular. The chapters include auto-ethnographic accounts and ethnographic explorations that reflect upon experiences of living with the pandemic and its implications for all areas of life. The book explicates people's dealings with COVID-19 at various levels, situates the spread of rumors, conspiracy theories, and new social rituals within micro- and/or macro-contexts, and describes the interplay between the virus and various institutionalized forms of inequalities and structural vulnerabilities. Bringing together a variety of perspectives, the volume relates to the past, describes the Covidian present, and offers futuristic implications. It enlists distinct imaginaries based on current understandings of an extraordinary challenge that holds significant importance for our human future.
