Mobilizing the Metropolis : How the Port Authority Built New York

The Port Authority of New York and New Jersey has morphed in ways that would be unrecognizable to its founders. Its mission evolved from improving rail freight to building motor vehicle crossings, airports, office towers, and industrial parks and taking control of a failing commuter rail line. In its early years, the agency was often viewed with admiration; however as it drew up plans, negotiated to take control of airfields and marine terminals, and constructed large bridges and tunnels, the Port Authority became the object of less favorable attention. It was attacked as a “super-government” that must be reined in, while the mayors of New York and Newark argued that it should be broken up with its pieces given to local governments for their own use. Despite its criticisms and travails, for over half a century the Port Authority overcame hurdles that had frustrated other public and private efforts, built the world's longest suspension bridge, and took a leading role in creating an organization to reduce traffic delays in the New York -New Jersey region. How did the Port Authority achieve these successes? And what lessons does its history offer to other cities and regions in the United States and beyond? In a time when public agencies are often condemned as inefficient and corrupt, this history should provide some positive lessons for governmental officials and social reformers. In 2021, the Port Authority marked its 100th birthday. Its history reveals a struggle between the public and private sectors, the challenges of balancing democratic accountability and efficiency, and the tension between regional and local needs. From selected Port Authority successes and failures, Philip Mark Plotch and Jen Nelles produce a significant and engaging account of a powerful governmental entity that offers durable lessons on collaboration, leadership, and the challenge of overcoming complex political challenges in modern America.

A New Bankruptcy Subchapter for Institutions of Higher Education: A Path but not a Destiny.

Almost any financially distressed entity can attempt to restructure under chapter 11 of the Bankruptcy Code1 while continuing to operate. Institutions of higher education ("IHEs") present one of the few exceptions. The moment a bankruptcy is filed, IHEs forfeit federal financial aid funding, their primary source of liquidity. Continued operations are impossible and going-concern value dissipates. Recent articles explain why the purported policy supporting the current treatment of IHEs is stale and misplaced, while the question of how they should be treated remains unexplored. This article fills the void and suggests administering IHE restructurings through the enactment of an IHE-specific subchapter to chapter 11 of the Bankruptcy Code. Restructuring IHEs requires navigation of cross-cutting priorities including: (i) protecting the public interest in federal financial aid funds, (ii) minimizing' reputational stigma to ensure continued viability, (iii) facilitating an efficient restructuring, and (iv) treating students' interests fairly. To accomplish this challenging task, the proposed subchapter draws from both scholarly and historical sources including Professor Laura Coordes's recent articles examining the challenges of restructuring of heavily regulated healthcare business entities and lessons from Congress's evolving treatment of railroad reorganizations. More specifically, the proposed subchapter: (i) grants the Department of Education veto power over a bankruptcy filing, (ii) implements an accelerated case timeline, (iii) incorporates a form restructuring support agreement, (iv) elevates students' claims and safeguards their records, and (v) facilitates the resolution of conflicts between the Bankruptcy Code and substantive non-bankruptcy law. Confronted by an inability to operate in chapter 11, financially distressed IHEs resort to bankruptcy liquidations, receiverships, and workouts as restructuring alternatives. To evidence the necessity of a subchapter, this article provides the first comprehensive evaluation of these options and animates each discussion with an IHE example. These case studies confirm that the alternatives are poor substitutes and provide further support for the provisions of the proposed subchapter. Admittedly, changing the Bankruptcy Code is a heavy lift, however, it is consistent with Congress's disparate treatment of IHEs. The current bankruptcy restructuring preclusion is a product of the 1990s, when evergrowing demand made the isolated incidents of financial distress appear to arise solely from fraud or wrongdoing. Change is now warranted in the face of increasing financial pressures resulting from demographic shifts and preference switches. After showing that the existing alternatives for IHEs fall short, this article marshals the evidence for enacting an IHE subchapter and outlines its composition. [ABSTRACT FROM AUTHOR]

Justin Driver maintains that since the 1970s the Supreme Court has regularly abdicated its responsibility for protecting students'constitutional rights and risked transforming public schools into Constitution-free zones. Students deriving lessons about citizenship from the Court's decisions in recent decades would conclude that the following actions taken by educators pass constitutional muster: inflicting severe corporal punishment on students without any procedural protections, searching students and their possessions without probable cause in bids to uncover violations of school rules, random drug testing of students who are not suspected of wrongdoing, and suppressing student speech for the viewpoint it espouses. Taking their cue from such decisions, lower courts have upheld a wide array of dubious school actions, including degrading strip searches, repressive dress codes, draconian “zero tolerance” disciplinary policies, and severe restrictions on off-campus speech. Driver surveys this legal landscape with eloquence, highlights the gripping personal narratives behind landmark clashes, and warns that the repeated failure to honor students'rights threatens our basic constitutional order. This magisterial book will make it impossible to view American schools—or America itself—in the same way again.

The volumes in this series are, published annually on the occasion of the International Conference on Dialysis organized by the Renal Research Institute, New York , in collaboration with the ISN, ISPD, NKF and RPA. This year's meeting emphasized differences in opinion regarding dialysis guidelines, measurement of dialysis dose and the value of observational research. Besides, this volume includes papers on problems inherent in the management of a dialysis center; diabetes and dialysis; new information on topics such as dialysate composition; the role of body composition in dialysis outcome; problems associated with excess or deficiency of vitamin C; application of nanotechnology, or the role of periodontal disease as a cause of problems in dialysis patients. Last but not least, a molecular approach to infection in chronic kidney disease is presented, using detection of bacterial DNA in patients with sepsis. Covering a broad spectrum of topics, this publication is thus a most helpful reference tool for both clinicians and basic investigators involved in hemodialysis.

The article presents information about several congresses and conferences as well as associations related to the economic conditions of the U.S. The twenty-sixth annual meeting of the American Economic Association will be held at Minneapolis, from December 27-30,1913. The executive committee meeting will be held on December 27 followed by a business meeting of the association with reports of committees , etc. The first session of the association will be held on December 27, 1913. The subject for discussion will be on the Control of Public Service Corporations. The Seventh National Conference on State and Local Taxation was held under the auspices of the National Tax Association at Buffalo, New York State, on October 23-25. 245 delegates were representing 18 colleges and universities including 33 states, Canada, and Porto Rico. For the most part, the discussions followed those of last year, the chief topics being centralization of administration, classification of property, and the taxation of corporations, forests, and mines.

Written by leading scholars of African American and women's history, the essays in this volume seek to reconceptualize the political history of black women in the United States by placing them'at the center of our thinking.'The book explores how slavery, racial discrimination, and gender shaped the goals that African American women set for themselves, their families, and their race and looks at the political tools at their disposal. By identifying key turning points for black women, the essays create a new chronology and a new paradigm for historical analysis. The chronology begins in 1837 with the interracial meeting of antislavery women in New York City and concludes with the civil rights movement of the 1960s.

The Routledge Handbook of Taxation and Philanthropy ventures into a territory that is still widely unexplored. It contains 30 academic contributions that aim to provide a better understanding of whether, why, and how philanthropic initiatives, understood as voluntary contributions for the common good, can and should be fostered by states through tax incentives. The topic has been addressed from a multidisciplinary and multicultural perspective – covering neuroeconomics, sociology, political science, psychology, affective sciences, philosophy, behavioral economy, and law – because of its global and multifaceted nature. It also contains the OECD report on Taxation and Philanthropy released in November 2020, which was prepared in this context as a result of a collaboration with the Geneva Centre for Philanthropy of the University of Geneva. The book is divided into four sections, exploring, respectively, the justification of tax incentives for philanthropy, theoretical and empirical insights about taxes, efficiency and donor behavior in that context, and tax incentives for cross-border philanthropy and for hybrid entities and social entrepreneurship. It is believed that this volume will be a landmark yet only the beginning of a journey in which a lot remains to be studied, learned, and said.

Tax evasion, tax avoidance and tax resistance are widespread phenomena in political, economic, social and fiscal history from antiquity through medieval, early modern and modern times. Histories of Tax Evasion, Avoidance and Resistance shows how different groups and individuals around the globe have succeeded or failed in not paying their due taxes, whether in kind or in cash, on their properties or on their crops. It analyses how, throughout history, wealthy and poor taxpayers have tried to avoid or reduce their tax burden by negotiating with tax authorities, through practices of legal or illegal tax evasion, by filing lawsuits, seeking armed resistance or by migration, and how state authorities have dealt with such acts of claim making, defiance, open resistance or elusion. It fills an important research gap in tax history, addressing questions of tax morale and fairness, and how social and political inequality was negotiated through taxation . It gives rich insights into the development of citizen-state relationships throughout the course of history. The book comprises case studies from Ancient Athens, Roman Egypt, Medieval Europe, Early Modern Mexico, the Ottoman Empire, Nigeria under British colonial rule, the United Kingdom of the early 20th century, Greece during the Second World War, as well as West Germany, Switzerland, Sweden and the United States in the 20th century, including transnational entanglements in the world of late-modern offshore finance and taxation . The authors are experts in fiscal, economic, financial, legal, social and/or cultural history. The book is intended for students, researchers and scholars of economic and financial history, social and world history and political economy.
