Evolution of the United States Economic Censuses: The Nineteenth and Twentieth Centuries.

The economic censuses reflect growing industrialization and the spread of communications in the United States since the early 19th century. Temporary organizations took these censuses with increasing detail almost every 10 years from 1810 to 1900. Demands for more frequent enumerations and current data were major factors in the establishment of a permanent census office in 1902. The 20th century features censuses of manufactures every two years and later at five-year intervals, construction industries; mineral industries; minority- and women-owned businesses; retail and wholesale trades; service industries; financial, insurance, and real estate industries; truck inventory and use survey; commodity flow survey; transportation, communications and utilities. In the 1950s, the censuses were integrated to ensure complete, unduplicated, comparable data for all of their components. Enumeration was increasingly by mail and, for small establishments, by the use of administrative records in lieu of returns. The introduction of mechanical, electronic tabulation, and computers and CD-ROMs increased the variety of data products available and how the information could be accessed. [ABSTRACT FROM AUTHOR]

This handbook comprises essays by leading scholars and practitioners on the topic of U.S. counterterrorism and irregular warfare campaigns and operations around the globe. Terrorist groups have evolved substantially since 9/11, with the Islamic State often described as a pseudo-state, a terrorist group, and insurgency all at the same time. While researchers', analysts', and policymakers'understanding of terrorism has grown immensely over the past two decades, similar advancements in the understanding of counterterrorism lag. As such, this handbook explains why it is necessary to take a broader view of counterterrorism which can, and often does, include irregular warfare. The volume is divided into three thematic sections: Part I examines modern terrorism in the Islamic world and gives an overview of the major terrorist groups from the past three decades; Part II provides a wide variety of case studies of counterterrorism and irregular warfare operations, spanning from the 1980s to the irregular warfare campaign against the Islamic State in northern Syria in 2018; Part III examines the government instruments used to combat terrorism and wage irregular warfare, such as drones, Theater Special Operations Commands, and Theater Commands. The handbook fills a gap in the traditional counterterrorism literature by its inclusion of irregular warfare and by providing analyses from academic experts as well as practitioners. It will be of much interest to students of counterterrorism, counterinsurgency, U.S. national security, military affairs, and International Relations. PRETEXT, REALITY, AND VERISIMILITUDE: TRUTH-SEEKING IN THE SUPREME COURT.

The assault on truth in recent public discourse makes it especially important that judicial decisions about Executive actions reflect the world as it is. Judges should not assume some idealized reality where good faith prevails, the motives of public officials are above reproach, and administrative processes are presumptively regular. Unfortunately, however, the Supreme Court has acted on naïve or counterfactual assumptions that limit judicial review of administrative or Presidential action. Such intentional judicial blindness or suspension of justified disbelief-such lack of verisimilitude-can sow doubt regarding the Court's candor and impartiality. In analyzing the Court's fealty to objective reality in its review of Executive actions, this Article focuses primarily on two Supreme Court decisions: the Travel Ban Case and the Census Case. These decisions illustrate how themode of judicial review can influence verisimilitude. In the Travel Ban Case, the Court refused to look behind an implausible explanation of the government's actions, a paradigm judicial departure from verisimilitude inimical to the legitimacy of the Court. The Census Case is a less direct assault on objective reality, as the Court ultimately did examine the truthfulness of the government's justifications. But it did so in a manner that does not manifest a vital commitment to truth. This Article will also touch upon a third case: U.S. Department of Homeland Security v. Regents of the Univ. of Cal. (the DACA Case). The DACA Case did not challenge objective reality but on the contrary insisted that agencies provide the actual reasoning behind their decisions rather than justifications they thought of later, even if those justifications were otherwise valid. The case thus reinforces the importance of candor and accuracy. A key lesson from these cases is that to preserve its legitimacy, the Court should abandon or modify doctrines that cede judicial review of national security issues, limit consideration of 'pretext, decline to assess the intent of government actors, and indulge a presumption of regularity for administrative determinations. These reforms are achievable without amajor overhaul of administrative law standards. [ABSTRACT FROM AUTHOR]
