Znaczenie siły powietrznej dla prowadzenia operacji wojskowych jest współcześnie niepodważalne. Lotnictwo było jednym z kluczowych elementów sukcesu polityczno-militarnego w niemal wszystkich konfliktach XX wieku. Niestety, pomimo wielkiego znaczenia tego rodzaju sił zbrojnych, niewspółmiernie skąpe są rozważania na temat aspektów prawnych operacji lotniczych, zwłaszcza w świetle międzynarodowego prawa humanitarnego. Okoliczność ta była często wykorzystywana przez walczących, którzy, operując w „szarej strefie” prawa wojny, dokonywali co najmniej kontrowersyjnych ataków na ośrodki miejskie, gdzie ginęli niewalczący. Książka ta nie jest ograniczona wyłącznie do najbardziej dyskutowanego aspektu bombardowania, lecz dotyczy także innych zagadnień związanych z wojną powietrzną, nieopisywanych szerzej w literaturze przedmiotu.

The International Criminal Court : A Global Civil Society Achievement

A new examination of the International Criminal Court (ICC) from a political science and international relations perspective. It describes the main features of the court and discusses the political negotiations and the on-going clashes between those states who oppose the court, particularly the United States, and those who defend it. It also makes these issues accessible to non-lawyers and presents effective advocacy strategies for non-governmental organizations. It also delivers essential background to the place of the US in international relations and makes a major contribution to thinking about the ICC's future. While global civil society does not deliver global democracy, it does contribute to more transparent, more deliberative and more ethical international decision-making which is ultimately preferable to a world of isolated sovereign states with no accountability outside their borders, or exclusive and secretive state-to-state diplomacy. This book will be of great interest to students and scholars of international relations, international law, globalization and global governance.

Lawyers had been producing reports of trials and appellate proceedings in order to understand the law and practices of the Westminster courts since the Middle Ages, and printed reports had appeared in the late fifteenth century. This book considers trials in the regular English criminal courts in the eighteenth and nineteenth centuries. It also considers the contribution of criminal lawyers in developing the modern rules of evidence. The book explores the influence of scientific and pseudoscientific knowledge on Victorian insanity trials and trials for homosexual offences, respectively. The British Trials Collection contains the only readily accessible and near-verbatim accounts of civil trials from the 1760s, 1770s, and 1780s, decades crucial to understanding how the rules of evidence developed. It might be thought that Defence of the Realm Acts (DORA) or its regulations would have introduced trials in camera. The book presents a comparative critique of war crimes trials before the International Military Tribunals at Nuremberg and Tokyo and the International Tribunals for the former Yugoslavia and for Rwanda. The first spy trial by court martial after the legal change in 1915 was that of Robert Rosenthal, who was German. The book also considers the principal features of the first war crimes trial of the twenty-first century in terms of personnel and procedures, the alleged crimes, and issues of legality and legitimacy. It also speculates on the narratives or non-narratives of the trial and how these may impact on the professed aims and objectives of the litigation.

Seeking to shed light on how we might end mass incarceration, The Price of Freedom compares the histories and goals of the American and German justice systems. Drawing on repeated in-depth interviews with incarcerated young men in the United States and Germany, Michaela Soyer argues that the apparent relative lenience of the German criminal justice system is actually founded on the violent enforcement of cultural homogeneity at the hands of the German welfare state. Demonstrating how both societies have constructed a racialized underclass of outsiders over time, this book emphasizes that criminal justice reformers in the United States need to move beyond European models in order to build a truly just, diverse society.

This volume contains the proceedings of the 12th International Conference on Geosynthetics (12 ICG), held in Roma, Italy, 17-21 September 2023. About 750 Authors - Academics, Researchers, Students, Practitioners, Contractors and Manufacturers – contributed to the peer-reviewed papers of this volume, which includes the Giroud lecture, the Bathurst lecture, the Rowe lecture, four keynote lectures and 296 technical papers. The content of these proceedings illustrates the sustainable use of geosynthetics in a variety of innovative as well as consolidated applications. Der Staatssekretär im Reichsministerium des Innern Wilhelm Stuckart (1902-1953) war einer der wichtigsten juristischen Interpreten und Legitimatoren des NS-Staates. Als Mit-Autor der Nürnberger Rassegesetze goss er dessen biologistische Grundlagen in Gesetze und begleitete später die Vorbereitungen zum Genozid. Im Frühjahr 1942 vertrat er auf der Endlösungskonferenz am Wannsee sein Ressort. Nach dem Krieg gehörte Stuckart zu den Schöpfern der Legende von der'sauberen Verwaltung', die sich den rassistischen Ansprüchen der NS-Machthaber widersetzt habe. Die biographische Auseinandersetzung mit Stuckart belegt nicht nur die prägende Funktion von führenden Juristen in der NS-Verwaltung, sie untersucht auch die Rolle der Innenverwaltung und ihre Mitwirkung am Genozid. Hans-Christian Jasch ist für seine Arbeit mit dem Richard-Schmid-Preis für Justizgeschichte 2012 des Forums Justizgeschichte ausgezeichnet worden.
