Child fatality in families with prior CPS history : Do those with and without intimate partner violence differ?

Research indicates many children who experience maltreatment are also exposed to intimate partner violence (IPV). Some studies find that children with child protective services (CPS) history have higher risk of preventable child fatality (CF). It is not known if there are unique characteristics of families with combined CPS and IPV histories that could inform service plans to reduce risk of later CF. Information from documents published in the Innocents Lost Database was extracted and analyzed, and linked to county level census data. The sample includes CFs from 501 Florida families that occurred from 2008 to 2015. Families had a history of CPS contact, but cause of death varied. Bivariate (t-test, chi-square, correlation) and logistic regression analyses compared CF cases with and without IPV mentioned in the full sample (n = 501) and the reduced sample (n = 155 with in-depth documentation). Prevalence of IPV ranged from 34 to 46% (full and reduced sample respectively) with violent death more common for this group. CFs with noted IPV histories were more likely to involve school-aged children from larger families. Such cases were more likely to include primary caregivers with noted mental health and substance abuse concerns, and/or prior criminal justice system contact and secondary caregivers with criminal justice histories . IPV was common among preventable CFs with prior CPS histories . Caregivers in these families had substantial prior contact with both CPS and other adult service and criminal justice systems. Implications for risk screening and preventive services within adult-serving systems and schools are discussed. [ABSTRACT FROM AUTHOR]

There Is No Such Thing as Zero Risk of Sexual Offending.

The public is justifiably concerned about the risk presented by individuals with a history of sexual crime. Given that recidivism risk varies across individuals and over time, what level is so low as to be indistinguishable from sexual recidivism risk in the general population (a desistance threshold)? This risk is not zero. Comparing census data with the number of males convicted of sexual offences in the province of British Columbia in two cohorts (2006, N = 362; 2011, N = 422), we found that approximately 1% of all adult males in British Columbia would be expected to be convicted of a sexual offence by age 50. Across the full lifespan (until 99), that proportion was estimated to be 1.38% for the 2006 cohort and 1.50% for the 2011 cohort. Other research has found that most individuals released from a sexual offence present a similarly low residual risk (< 2%) after 10 years of being offence-free in the community. Consequently, applying long-term restrictions (e.g., lifetime registration; Criminal Code of Canada §161) to such individuals serves no public protection function. [ABSTRACT FROM AUTHOR]

Correlates of incarceration history among military veterans.

Veterans with histories of incarceration are at greater risk for poor physical and mental health outcomes, yet prior research in this population has focused on specific subsets of veterans or a narrow range of predictors. We utilized the Bronfenbrenner Socioecological Model as the framework to evaluate correlates of incarceration history in a large sample of Iraq and Afghanistan-era veterans at four levels: demographic, historical, clinical, and contextual. Participants were 2,904 veterans (76.9% male; 49.5% White and 46.5% Black; mean age 38.08, SD = 10.33), 700 of whom reported a history of incarceration. Four logistic regression models predicting history of incarceration were tested, adding demographic, historical, clinical, and contextual variables hierarchically. In the final model, younger age (OR = 0.99, 95% CI = 0.98–1.00), male gender (OR of being female = 0.28, 95% CI = 0.21–0.38), belonging to a historically marginalized group (OR of being White = 0.69, 95% CI = 0.56–0.84), family history of incarceration (OR = 1.47, 95% CI = 1.10–1.94), adult interpersonal trauma (OR = 1.39, 95% CI = 1.28–1.51), problematic alcohol use (OR = 1.03, 95% CI = 1.02–1.05), drug abuse (OR = 1.15, 95% CI = 1.11–1.19), and unemployment (OR for being employed = 0.76, 95% CI = 0.62–0.92) were significantly associated with a history of incarceration. Implications of these findings for developing interventions and supporting systems to effectively target this high-risk population of veterans are discussed. [ABSTRACT FROM AUTHOR]

The regulation of child pornography in China and the United States: A comparative review of laws.

Grounded in comparative law research, this paper compares differences in the regulation of online child pornography in China and the United States. The United States began regulating child pornography through criminal law in the 1970s, gradually refining the laws to distinguish between child pornography and obscenity and prohibit the possession of child pornography and virtual child pornography. In contrast, China treats child pornography on an equal footing with adult pornography, but imposes more lenient penalties on disseminating child pornography, which has led to the proliferation of child pornography. By comparing the two countries' policies and laws on child pornography, this review makes four recommendations for other countries: (i) define child pornography in criminal law; (ii) distinguish between obscenity and child pornography; (iii) prohibit virtual child pornography on the internet; and (iv) increase criminal penalties for child pornography. In seiner Untersuchung erforscht Hendrik Pekárek die Entwicklung des Straf-, Strafvollzugs und Strafprozessrechts in der jüdischen Rechtstradition, der Halacha, unter literarischen bzw. narrativen, rechtshistorischen und rechtsvergleichenden Aspekten. Anhand von »Kriminalgeschichten« und Regelungsbeispielen aus Torah, Midrasch, Mischna und Talmud, den Schriften Moses Maimonides und mittelalterlichen Rechtsgutachten zeichnet er anschaulich die über drei Jahrtausende währende Entfaltung strafrechtlicher Konzepte sowie die rabbinische Vorstellung eines gerechten Strafprozesses nach und gewährt einen Einblick in das Rechtsleben jüdischer Gemeinden im Laufe der Jahrhunderte. Die mit dem Sonderpreis der Humboldt-Universität 2019 ausgezeichnete Arbeit leistet nicht nur einen interdisziplinären Beitrag zur Erforschung des Jüdischen Rechts, sondern auch zu den religiösen Ursprüngen des säkularen Strafrechts und damit gleichsam zur Aufarbeitung der Strafrechtsentwicklung in Europa.

How a moral panic influenced the world's first blanket ban on new psychoactive substances.

Ireland passed the world's first blanket ban on new psychoactive substance in 2010. This article traces the historical processes culminating in the Criminal Justice (Psychoactive Substances) Act (2010) through a systematic review of Irish media articles published between 2000 and 2010 (N = 338). The review found that head shops were largely tolerated when they sold cannabis paraphernalia (2000–2008), possibly indicating the normalisation of cannabis in Ireland. Some mild condemnatory language emerges between 2008 and 2009 when head shops began selling some new psychoactive substances. The review suggests that the 2010 Act was partly a product of a moral panic, driven and managed by a range of moral entrepreneurs and, involving both peaceful and violent protests. Unlike some traditional moral panics, young people were not identified as folk devils but rather as under threat from a new drug distribution model (head shops) and new drugs (NPS). Sport for Development and Decolonization in a Settler Colonial State: Physical Culture in the Lives of Indigenous Peoples Incarcerated in Canadian Prisons.

This article considers if sport, broadly defined, can be constructed as a decolonizing practice for Indigenous Peoples incarcerated in Canadian prisons. Situating our analysis within transformative and decolonizing approaches to sport for development, we bring together disparate literatures—on settler colonialism and Indigenous incarceration, decolonization and Indigenous resurgence, and sport and incarceration—to critically analyze possibilities and limitations of sport as a vehicle for decolonization in an inherently colonial institution. Recognizing the structural constraints to such a process, we also critique the settler colonial state and criminal justice system in which many Indigenous Peoples are enmeshed. The article contributes to sport for development's ongoing engagement with issues of decolonization and criminal justice. [ABSTRACT FROM AUTHOR]

HOW THEY GET AWAY WITH MURDER: THE INTERSECTION OF CAPITAL PUNISHMENT, PROSECUTOR MISCONDUCT, AND SYSTEMIC INJUSTICE.

Black defendants are executed at a disproportionately high rate, an injustice quietly persisting in the shadow of America's dark history of slavery and Jim Crow. While a variety of intersectional factors have perpetuated this injustice, the role of prosecutors who commit misconduct to secure a conviction is significant. Defendants are presumed innocent until proven guilty, but when the prosecutors who carry the burden of proving that guilt choose not to play by the rules, they wantonly and recklessly embrace the risk of convicting-even killing-an innocent person. This Comment focuses on two primary forms of prosecutor misconduct: Batson violations that occur during jury selection when a prosecutor uses his or her peremptory strikes in a racially discriminatory manner, and Brady violations that occur when the prosecution suppresses materially exculpatory evidence. from the defense. While the Supreme Court has established Fourteenth Amendment safeguards to protect criminal defendants from these forms of misconduct, this Comment argues that those safeguards are incomplete. Fourteenth Amendment jurisprudence fails adequately both to deter prosecutorial misconduct and to guarantee that criminal defendants receive a fair trial. These failures are only amp lifted for Black capital defendants, who experience disproportionally higher rates of prosecutor misconduct and capital sentencing. Seeking to better deter incidents of prosecutor misconduct and better ensure Black capital defendants receive due process of law, this Comment proposes a four-part Model Act. Inspired by the Sentencing Reform Act of 1984 and the Federal Sentencing Guidelines, this Act (1) creates a state commission for prosecutor misconduct, (2) charges the commission with the role of drafting advisory guidelines for classifying prosecutor misconduct, (3) mandates that the commission consider the guidelines prior to imposing sanctions on prosecutors found to have committed misconduct. and (4) mandates that state judges consider the guidelines prior to imposing remedies for cases affected by misconduct.
