Interesting. Several years ago I wrote for a semi-pro APA which had a
circulation of about 25-30. I always considered the stuff I wrote
there to be published for copyright purposes, but this interpretation
might mean that it wasn't. (I since made much of the material
available on my Website, thus making it very widely available...)
Also, many years ago there was a practice among publisher,
particularly those of comic books and other pulp magazines, to make a
*very* small print run of titles for trademark and copyright purposes
and to show to adventisers--basicaly just enough copies to send in to
the TPO & LoC and have a couple to keep on file. (Whiz Comics #1, the
first appearance of Captain Marvel [Shazam!] is a classic example).
